How does mediation work?
Mediation is a non-adversarial approach to resolving your marital issues. Mediation is conducted by an impartial third party you and your spouse choose to help you settle your case. The mediator does not provide you or your spouse with legal representation. Rather, the mediator’s role is to help you and your spouse find ways to resolve your differences without involving the court. You can participate in mediation without an attorney but you should always seek independent legal advice. If mediation is successful, the mediator will prepare a memorandum of understanding outlining the terms that have been agreed to. An attorney for you or your spouse will use the memorandum of understanding as the basis for drafting a comprehensive settlement agreement.
Mrs. Agostini is a court approved family law mediator and she is often appointed by the court to mediate disputes between divorcing parties. She has negotiated settlement agreements for many of her clients and will use her negotiating skills to assist you in reaching an agreement.
